Bill Summary

Relative to requiring choke response employee training in all restaurants. Public Health.

This bill requires all food establishments in Massachusetts to have at least one employee trained in approved manual procedures to remove food lodged in a person's throat. The Department of Public Health will adopt regulations listing the approved procedures. Food establishments must also have adequate insurance coverage for these trained employees. The local boards of health will notify food establishments of their obligations and provide them with information on training sites and the relevant statute. Employees who have been properly trained and in good faith attempt to remove food from a person's throat during an emergency will not be liable for any civil damages. However, take-out only restaurants without customer seating and food trucks are exempt from this requirement.
