This bill authorizes county commissioners and sheriffs to institute a schedule of fees and assess those fees to inmates in their custody. The fees include a daily cost of custodial care fee (up to $5), medical and dental sick call visit fees (up to $5 each), a prescription eyeglasses fee (up to $5), and a pharmacy prescription fee (up to $3 per prescription). The bill requires facilities to establish a procedure for inmates to appeal any fee assessments, and it exempts certain essential medical services from fee assessment. The bill also stipulates that inmates cannot be denied access to care due to inability to pay, and that unpaid fees will be debited from the inmate's account, with the debt forgiven if the inmate is not incarcerated within two years of release. The bill does not apply to federal inmates, detainees, or regional lock-up inmates, and the commissioners and sheriffs are required to promulgate rules and regulations for the implementation of this section.
