This bill makes the following key changes: 1. It requires defendants sentenced for the primary offense of possession of a controlled substance with 60 or fewer total sentencing points to be sentenced to a non-state prison sanction, unless the court finds a non-state prison sanction could present a danger to the public. 2. It allows defendants convicted of offenses committed on or after October 1, 2019 that require a mandatory minimum term of imprisonment or mandatory fine to move the sentencing court to depart from the mandatory minimum, if certain criteria are met. 3. It revises the Criminal Punishment Code to require inmates to serve at least 65% or 85% of their sentence (depending on the offense) before becoming eligible for certain types of gain-time that could result in an earlier release. 4. It allows certain persons convicted of a noncapital offense and sentenced to life imprisonment to qualify for conditional release after serving 20 years with no disciplinary issues. The bill aims to reform criminal sentencing and gain-time policies, particularly for non-violent drug offenses, in order to reduce incarceration rates while still maintaining public safety.
