This bill amends the existing Massachusetts law (Chapter 61A) to encourage the use of renewable energy on agricultural land. The key provisions are: 1. The bill allows land used primarily for agriculture or horticulture to also be used to site a renewable energy generating source, such as solar, if it does not impede the continued use of the land for agricultural or horticultural purposes. 2. Land used for both agricultural/horticultural purposes and to site a renewable energy generating source is deemed to be in agricultural or horticultural use and eligible for the benefits and protections afforded to such land under the law. 3. Renewable energy generating sources located on agricultural or horticultural land are subject to the same provisions and protections as the agricultural use of the land. The overall purpose of this bill is to facilitate the development of renewable energy projects on farmland and horticultural land in Massachusetts without compromising the primary agricultural or horticultural use of the land.
