This bill proposes to expedite the transfer of cases to the permit session of the land court in Massachusetts. Specifically, it amends the existing law to allow any action not commenced in the permit session and not claiming a valid right to a jury trial, but within the jurisdiction of the permit session, to be automatically transferred to the permit session upon the filing of a notice by any party demonstrating compliance with the jurisdictional requirements. The bill also includes provisions for the extension of time to file responsive pleadings and a presumption against more than one transfer of a case between any departments of the trial court. If a party claims a valid right to a jury trial, the action will be remanded to the original court for a jury trial.
