This bill aims to ensure the safety of communities and citizens by prohibiting the Commonwealth, its political subdivisions, or their employees from establishing any operation or program that requires or causes people to register or be checked in based on their religion, national origin, nationality, citizenship, race, ethnicity, gender, gender identity, sexual orientation, or age. It also prohibits the use of state resources to enforce or implement any federal government operation or program that has a similar requirement. However, the bill does not apply to programs that merely collect data on foreign nationals entering or exiting the United States or those related to issuing visas, granting citizenship, or protecting non-citizens from removal. Additionally, the bill allows certain state and local law enforcement employees, such as police officers and court officers, to detain individuals for a reasonable period of time after their release from custody if they receive a written request from U.S. Immigration and Customs Enforcement and an administrative warrant, and a supervisory officer has determined that the individual poses a threat to public safety based on specific criteria. The bill also outlines the procedure for a judicial officer to make a probable cause determination for the detention.
