This bill amends the Texas Health and Safety Code to establish civil liability for a nursing facility resident's "responsible payor" (a person with legal access to the resident's funds who has agreed to pay for the resident's care) if they misappropriate the resident's funds to the extent that the resident can no longer afford their care. The bill allows the nursing facility to file an action against the responsible payor to recover the misappropriated funds, and permits the recovery of attorney's fees, subject to a cap equal to the amount misappropriated.
