This bill amends the Executive Law to authorize the institution of a lawsuit in any court of competent jurisdiction alleging a violation of the human rights law for a period of three years after the dismissal of a complaint for administrative convenience by the Division of Human Rights. The bill also allows a person with a pending complaint at the Division to request that the complaint be dismissed and their election of remedies be annulled so that the human rights law claim can be pursued in court. Additionally, the bill specifies that a complaint filed with the Equal Employment Opportunity Commission shall not constitute the filing of a complaint within the meaning of this provision.
