This bill authorizes individuals to participate in the NY State of Health, the official health plan marketplace, without providing information regarding citizenship or lawful residency in the United States or requesting or receiving a state or federal subsidy. The bill allows any qualified individual to enroll in a qualified health plan and pay all associated costs without needing to meet citizenship or lawful residency requirements. The commissioner is directed to seek a federal waiver to enable this and to develop a formula for the state to reimburse the federal government annually for the average administrative costs associated with these participants. The bill also requires the commissioner to protect the confidentiality of participants who do not provide a social security number or proof of legal status.
