Legislative Counsel's Digest: Section 9 of this bill requires the Director of the Department of Health and 1 Human Services to cause to be formed the Nevada Stem Cell Center, an 2 independent, nonprofit corporation formed for the general purposes of: (1) 3 providing treatments involving stem cells to patients; (2) performing research 4 related to stem cells; and (3) educating the public about stem cells. Section 10 of 5 this bill creates the Board of Directors of the Center. Section 11 of this bill 6 provides for the appointment of an Executive Director of the Center and sets forth 7 the duties of the Executive Director, which include overseeing the administration of 8 the Center and overseeing the treatment of patients and research involving stem cell 9 therapies. Section 12 of this bill creates the Nevada Stem Cell Center Account in 10 the State General Fund and authorizes the Executive Director, under the direction 11 of the Board, to administer the Account to further the purposes of the Center. 12 Section 13 of this bill makes an appropriation to the Account for the start-up costs 13 of the Center. 14 SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 439 of NRS is hereby amended by adding 1 thereto the provisions set forth as sections 2 to 12, inclusive, of this 2 act. 3 Sec. 2. As used in sections 2 to 12, inclusive, of this act, 4 unless the context otherwise requires, the words and terms defined 5 in sections 3 to 8, inclusive, of this act have the meanings ascribed 6 to them in those sections. 7 Sec. 3. Account means the Nevada Stem Cell Center 8 Account created by section 12 of this act. 9 Sec. 4. Adult, cord blood and related stem cells means 10 stem cells derived from postnatal tissue cells, umbilical cord blood 11 and cord tissue, including Wharton s jelly, amniotic fluid and 12 placental tissue. 13 Sec. 5. Board means the Board of Directors of the Nevada 14 Stem Cell Center. 15 Sec. 6. Executive Director means the Executive Director 16 of the Nevada Stem Cell Center appointed pursuant to section 11 17 of this act. 18 Sec. 7. Nevada Stem Cell Center or Center means the 19 independent, nonprofit corporation formed pursuant to section 9 20 of this act. 21 Sec. 8. Stem cell means an unspecialized or 22 undifferentiated cell that can self-replicate and has the potential to 23 differentiate into a specialized cell type. 24 Sec. 9. 1. The Director shall cause to be formed in this 25 State an independent, nonprofit corporation recognized as exempt 26 from federal income taxation for the public benefit named the 27 Nevada Stem Cell Center, the general purpose of which is to 28 carry out the provisions of sections 2 to 12, inclusive, of this act. 29 2. The Center shall: 30 (a) Deliver stem cell therapy involving adult, cord blood and 31 related stem cells to patients who consent to such therapy. Such 32 therapy may include, without limitation, clinical trials paid for by 33 patients. 34 (b) Perform research to understand and advance stem cell 35 therapies. 36 (c) Serve as a core facility to produce clinical-grade stem cells 37 from adult tissues, umbilical cord, cord blood and related 38 nonembryonic sources for use in clinical trials, therapies and 39 research. 40 (d) Collaborate with other physicians to treat patients at 41 regional hospitals with adult, cord blood and related stem cells. 42 (e) Facilitate the delivery of therapies involving adult, cord 1 blood and related stem cells to patients in hospitals and other 2 places for the care of the sick. 3 (f) Serve as a resource of information for patients and 4 physicians concerning clinical trials and research findings related 5 to stem cells. 6 (g) Provide education regarding stem cell therapy to the 7 public, including, without limitation, school children, 8 policymakers and health care professionals. 9 (h) Collaborate with the University of Nevada, Las Vegas, for 10 the purposes of research and education relating to stem cells. 11 (i) Partner with academic institutions, governmental entities, 12 hospitals, health care organizations, businesses and philanthropic 13 organizations to function as a translational engine for stem cell 14 discoveries and therapies in this State. 15 Sec. 10. 1. There is hereby created the Board of Directors 16 of the Nevada Stem Cell Center, consisting of the following 13 17 members: 18 (a) The President of the University of Nevada, Las Vegas. 19 (b) The Dean of the University of Nevada, Las Vegas, School 20 of Medicine. 21 (c) One member who is a physician or a scientist and has 22 substantial and demonstrated experience in the field of stem cell 23 therapy, appointed by the Dean of the University of Nevada, Las 24 Vegas, School of Medicine. 25 (d) One member who is a representative of the University 26 Medical Center of Southern Nevada, appointed by the Governing 27 Board of the University Medical Center of Southern Nevada in 28 consultation with the Board of County Commissioners of Clark 29 County. 30 (e) One member appointed by and representing the Governor. 31 (f) One member of the Senate, appointed by the Majority 32 Leader of the Senate. 33 (g) One member of the Senate, appointed by the Minority 34 Leader of the Senate. 35 (h) One member of the Assembly, appointed by the Speaker of 36 the Assembly. 37 (i) One member of the Assembly, appointed by the Minority 38 Leader of the Assembly. 39 (j) One member who is a representative of the Office of 40 Economic Development, appointed by the Governor. 41 (k) One member who is a representative of the Nevada State 42 Medical Association, appointed by the President of that 43 Association. 44 (l) One member who is a representative of the Board of 1 Regents of the University of Nevada, appointed by the Chair of the 2 Board. 3 (m) One member who possesses knowledge, skill and 4 experience with stem cell therapy, stem cell research and clinical 5 operations, appointed by the President of the University of 6 Nevada, Las Vegas, in consultation with the Dean of the 7 University of Nevada, Las Vegas, School of Medicine. 8 2. The member appointed pursuant to paragraph (m) of 9 subsection 1 shall serve as Chair of the Board. 10 3. Vacancies in the appointed positions on the Board must be 11 filled in the same manner as the original appointment. 12 4. Each member appointed to the Board serves a term of 3 13 years and may be reappointed. 14 5. The Board shall meet at least once in each quarter of the 15 year and may meet at other times at the call of the Chair. 16 6. A majority of the members of the Board constitutes a 17 quorum to transact all business. 18 7. The members of the Board serve without compensation. 19 Sec. 11. 1. The Dean of the University of Nevada, Las 20 Vegas, School of Medicine, in consultation with the Board, shall 21 appoint an Executive Director of the Nevada Stem Cell Center 22 who is entitled to such compensation as is determined by the 23 Board. 24 2. The Executive Director shall be responsible for: 25 (a) The administration of the Nevada Stem Cell Center, 26 including, without limitation, the overall direction of personnel, 27 equipment, operations and facilities of the Center. 28 (b) Overseeing the treatment of patients and research 29 involving adult, cord blood and related stem cells. 30 3. The Executive Director may solicit and accept gifts, grants 31 and donations from any source to carry out the provisions of 32 sections 2 to 12, inclusive, of this act. Any such gifts, grants and 33 donations must be deposited into the Account. 34 Sec. 12. 1. There is hereby created the Nevada Stem Cell 35 Center Account in the State General Fund. 36 2. Money for the Account may be provided: 37 (a) By appropriation; 38 (b) Through the acceptance of gifts, grants and donations as 39 authorized by section 11 of this act; or 40 (c) Through the collection of fees and charges pursuant to 41 subsection 3. 42 3. All money received by the Nevada Stem Cell Center for 43 core charges for cell processing and manufacturing, clinical trial 44 fees, service charges and any other money received by the Nevada 1 Stem Cell Center must be deposited into the Account. 2 4. Under the direction of the Board, the Executive Director 3 shall administer the Account. The money in the Account must be 4 used only for the purposes of: 5 (a) The treatment of patients with adult, cord blood and related 6 stem cells; 7 (b) Research related to stem cell therapy treatments; 8 (c) Education related to stem cells; and 9 (d) Any other purpose the Executive Director deems necessary 10 for carrying out the provisions of sections 2 to 12, inclusive, of this 11 act. 12 5. All expenditures from the Account must be approved by the 13 Executive Director. 14 6. The interest and income earned on the money in the 15 Account, after deducting any applicable charges, must be credited 16 to the Account. All claims against the Account must be paid as 17 other claims against the State are paid. 18 7. Any money remaining in the Account at the end of a fiscal 19 year does not revert to the State General Fund, and the balance in 20 the Account must be carried forward to the next fiscal year. 21 Sec. 13. There is hereby appropriated from the State General 22 Fund to the Nevada Stem Cell Center Account created by section 12 23 of this act the sum of $100,000 for the start-up costs of the Nevada 24 Stem Cell Center formed pursuant to section 9 of this act. 25
