This bill adds a new section to Idaho's motor vehicle laws to prohibit smoking or vaping in a motor vehicle if a minor (someone under the age of 18) is present. The bill defines "smoke" as inhaling and exhaling the fumes of a tobacco product or other drug, and "vape" as inhaling vapor through the mouth from a device that heats and vaporizes a liquid or solid. Enforcement of this law can only be done as a secondary action when the vehicle operator has been pulled over for a suspected violation of another law. Violators would be subject to a $50 fine, but the violation would not result in points on their driving record or be considered a moving violation for insurance purposes.
