This bill, the BPA-free Container Products Act, prohibits the manufacture, sale, or distribution of any food or beverage container that contains bisphenol A (BPA) at a level above 0.1 parts per billion. Manufacturers are required to use the least toxic alternative when replacing BPA and are prohibited from using carcinogens or reproductive toxicants as replacements. Violations of this law are considered unfair trade practices and subject to enforcement, penalties, and private lawsuits under the Unfair Trade Practices and Consumer Protection Law. The bill goes into effect 60 days after passage.
