This bill amends existing laws to restrict courts from issuing temporary or permanent child custody orders in certain situations involving domestic violence or abuse. Specifically, the bill prohibits courts from awarding sole, shared legal, or shared physical custody to a parent who has an active restraining order filed against them by the other parent under domestic violence or harassment laws. The bill also prevents courts from issuing permanent custody orders during the pendency of such restraining order cases or when a temporary restraining order has been granted without notice to the defendant. If a custody order is already in place and a subsequent restraining order is then issued, the court must revisit and modify the custody arrangement to comply with these new requirements.
