This bill amends the fourth paragraph of section 8A of chapter 239 of the General Laws, which deals with rent escrow. The key provisions are as follows: if a trial date is continued, the court must, upon the motion of any party, require the tenant to deposit with the court the amount due for use and occupancy each month or as required by the rental agreement, including any amount due from the start of withholding, calculated based on the fair market value of the premises. These amounts will be held in escrow pending the final disposition of the summary process action, and will first go towards repairs. If the tenant fails to comply with the deposit order, the court will schedule the matter for a bench trial at the earliest date and make any further orders it deems just.
