Bill Summary

A bill to amend chapter 171 of title 28, United States Code, to allow suit against the United States for injuries and deaths of members of the Armed Forces caused by improper medical care, and for other purposes. This bill allows claims to be brought against the United States for damages relating to the personal injury or death of a member of the Armed Forces arising out of a negligent or wrongful act or omission in providing medical, dental, or related health care functions at a military medical treatment facility. However, the bill does not apply to care provided at a medical treatment location deployed in an area of armed combat.

AI Summary

This bill, the SFC Richard Stayskal Military Medical Accountability Act of 2019, allows members of the Armed Forces to bring claims against the United States for damages related to personal injury or death caused by negligent or wrongful medical, dental, or related health care provided at a military medical treatment facility. The bill defines a "covered military medical treatment facility" to include certain facilities operated by the Department of Defense, but excludes battalion aid stations or other facilities deployed in areas of armed conflict. The bill establishes a 3-year statute of limitations for such claims, and specifies that certain exceptions in the Federal Tort Claims Act do not apply to these claims. The bill also requires the Secretary of Defense to submit biennial reports to Congress on the number of claims filed under this new provision.
