This bill allows Indian tribal governments to elect to receive payments, in lieu of tax credits, for energy property and electricity produced from certain renewable resources. The bill amends the Internal Revenue Code to add a new section that enables Indian tribal governments to make an election to receive payments from the government for the energy credits and renewable electricity production credits they would have otherwise claimed on their tax returns. The payments are treated as made on the due date of the tax return or the date the return is filed, and the income is excluded from the tribal government's gross income. This provides an alternative to the existing tax credit system for tribal governments to benefit from renewable energy investments.
