Bill Summary

Authorizing the release of certain land in the town of Cummington from the operation of an agricultural preservation restriction

AI Summary

This bill authorizes the release of a portion of a parcel of land in the town of Cummington from an agricultural preservation restriction. The released land, approximately 33,075 square feet, can only be used for cemetery purposes. If the land is sold or used for non-cemetery purposes, the agricultural preservation restriction will be reimposed. As a condition of the release, the town of Cummington must dedicate a 5.1-acre parcel of town-owned land for conservation purposes. If the value of the dedicated land is less than the value of the released land, the town must compensate the commonwealth for the difference, and the funds will be deposited into the Agricultural Preservation Restriction Mitigation Expendable Trust Fund.
