This bill increases the sentencing enhancements for the use of a firearm in the commission of a non-capital felony. Specifically, it increases the basic sentence of imprisonment by three years for the first offense and five years for subsequent offenses, and these enhanced sentences cannot be suspended or deferred, except for serious youthful offenders or youthful offenders where the sentence may be increased by the same amounts. The bill also requires the court or jury to make a separate finding of fact if a prima facie case has been established that a firearm was used in the commission of the offense.
