Bill Summary

A bill to establish a program to establish permanent features for flood control in areas in which temporary features have been constructed, and for other purposes. This bill provides that, upon request of a community that has received emergency flood-fighting assistance involving the construction of a temporary structure, the U.S. Department of the Army shall evaluate whether the structure should be made permanent. If the Army makes such a determination, it (1) shall begin planning, design, and construction of a permanent feature if the total construction cost of the project is not expected to exceed $25 million; and (2) shall seek congressional authorization if construction cost is expected to be in excess of that amount.

AI Summary

This bill, the LEVEE (Local Expertise is Vital for Effective Embankments) Act, establishes a program to convert temporary flood control structures into permanent features. Upon request from a community that has received emergency flood assistance involving temporary structures, the U.S. Department of the Army will evaluate whether those structures should be made permanent. If the Army determines the structure should be permanent and the project cost is under $25 million, the Army will begin planning, designing, and constructing the permanent feature. For projects over $25 million, the Army must seek congressional authorization. The non-federal cost-share for these projects is generally up to 35%, but can be up to 100% for small or disadvantaged communities based on their ability to pay.
