This bill allows for the resentencing of persistent offenders who were previously sentenced based on a conviction for second-degree robbery. The key provisions are: (1) Prosecutors must review sentencing documents for offenders sentenced as persistent offenders before July 28, 2019, and if second-degree robbery was used as a basis for the persistent offender finding, they must file a motion for resentencing; (2) The court must grant the motion and resentence the offender as if second-degree robbery was not considered a "most serious offense" at the time of the original sentence; and (3) This resentencing process expires on July 1, 2022.
