Bill Summary

This bill requires the installation of an ignition interlock device if a sentence for driving while intoxicated (DWI) or refusal to take a breathalyzer test is stayed pending appeal. Specifically, under the provisions of this bill, a court is not to grant a stay of a sentence imposed for DWI or refusal to take a breathalyzer test pending appeal unless the court requires the person whose sentence is stayed to install an ignition interlock device. At present, most persons who are convicted of DWI are required to install an ignition interlock device during the period of driver's license suspension and for a specific period after restoration of the license. Under the bill, the court is to order the installation of the ignition interlock device in the motor vehicle principally operated by the person. In addition, the device is to remain installed in the motor vehicle until the appeal is concluded.

AI Summary

This bill requires the installation of an ignition interlock device if a sentence for driving while intoxicated (DWI) or refusal to take a breathalyzer test is stayed pending appeal. Specifically, the court must order the installation of the ignition interlock device in the motor vehicle principally operated by the person whose sentence is stayed, and the device must remain installed until the appeal is concluded. This requirement applies to sentences imposed under the existing DWI law (R.S.39:4-50) and the law regarding refusal to take a breathalyzer test (section 2 of P.L.1981, c.512 (C.39:4-50.4a)).
