Bill Summary

AN ACT ENTITLED An Act to include out-of-state convictions for the basis of an enhanced penalty for the crime of stalking.

AI Summary

This bill amends the South Dakota law on stalking to include out-of-state convictions as the basis for an enhanced penalty. Specifically, the bill states that any prior conviction for stalking in another state within the last 10 years can be used to determine if the current violation is a second or subsequent offense, which carries a higher penalty as a Class 6 felony rather than a misdemeanor. Similarly, any prior out-of-state conviction for stalking involving violence or a credible threat of violence within the last 7 years can be used to classify the current violation as a second or subsequent offense, which is a Class 5 felony.
