This bill amends existing law to prohibit local entities from enacting distracted driving laws and to provide for certain distracted driving offenses and penalties. The bill defines "distracted driving" as operating a motor vehicle in a careless or erratic manner that endangers any person or property, such as by violating rules of the road. Distracted driving is considered a lesser offense than inattentive driving and carries fines of $50 for a first offense, $100 for a second offense within two years, and $300 for a third offense within two years, with additional fines for using a handheld wireless device. Third and subsequent offenses within two years result in violation points and are considered moving violations for insurance purposes.
