This bill creates the crime of "fraudulent assisted reproduction," which is when a health care professional purposely or knowingly uses a donor's human reproductive material without the consent of the person receiving the assisted reproduction procedure. The bill also allows the woman on whom the procedure was performed, her spouse or surviving spouse, and the resulting child to bring a civil action for remedies such as compensatory and punitive damages or liquidated damages if the procedure was performed without consent. Additionally, the donor of the human reproductive material may bring a civil action against the health care professional if the professional knew or should have known the material was used without the donor's consent.
