This bill adds a new chapter to Idaho's insurance laws, known as the "No Surprises Act," which aims to protect patients covered by health benefit plans from surprise medical billing practices. Prohibiting providers from billing patients covered by a health benefit plan for amounts exceeding the amount the plan would pay a contracted provider for the same services in the same geographic area, plus the patient's applicable coinsurance, deductible, and copayment. 2. Requiring the patient's health benefit plan to pay the provider the amount described above directly, and allowing the insurance director to inquire with the plan to verify the payment is consistent with the law. 3. Voiding any provisions in consent forms or agreements that would allow providers to bill for amounts in excess of what is permitted under the law, with some exceptions for patients who agree in writing to receive services from an out-of-network provider at a contracted facility. 4. Applying the law to self-funded group health plans governed by federal law, if the plan elects to participate by providing annual notice to the insurance director.
