This bill amends existing law to provide for a petition process where any person can request a waiver or variance from an administrative rule. The agency must either deny the petition in writing, stating the reasons, or approve the petition and grant the waiver or variance, potentially with conditions or a specified time period. The agency must take action on the petition within 28 days, unless it is adopted by a multi-member board or commission, in which case the agency must act at the first regularly scheduled meeting that is at least 7 days after the petition is submitted. If the agency requests additional information, the time period starts over. After granting a waiver or variance, the agency must consider a rule change to allow all similarly situated persons to receive the same benefits.
