This bill amends existing law to provide that certain records of the Public Defense Commission shall be exempt from disclosure. Specifically, it exempts records containing information protected or exempted from disclosure under the rules adopted by the Idaho Supreme Court, attorney work product, attorney-client privileged communication, records containing confidential information from an individual about their criminal case or their attorney's performance, or confidential information about an inquiry into an attorney's fitness to represent indigent defendants. Additionally, the bill exempts records related to the administration of the extraordinary litigation fund by the Public Defense Commission, to the extent that such records contain information protected or exempted from disclosure under the rules adopted by the Idaho Supreme Court, attorney work product, or attorney-client privileged communication. However, the amount awarded based on an application for extraordinary litigation funds is not exempt from disclosure.
