This bill adds to existing law to establish provisions regarding teledentistry and restrictions for such practice. The key provisions are: 1. It defines the practice of dentistry to include providing telehealth services, also referred to as teledentistry, in accordance with Idaho law and the community standard of care where the patient is located. Before providing teledentistry services, a dentist must provide the patient with their contact information and the contact information of all dental providers who may be working with the patient. 2. It requires a dentist to either establish a referral relationship with a licensed dentist within the area of the patient's location or obtain a signed patient notification acknowledging that in-person dental examination and treatment may be required, before providing teledentistry services. 3. It prohibits a dentist from authorizing or performing, either directly or through the use of telehealth communication technologies, dental procedures to correct the malposition of human teeth without first conducting an in-person comprehensive oral evaluation and review of the patient's diagnostic imaging, or reviewing the patient's records from a recent in-person comprehensive oral examination and diagnostic imaging. 4. It prohibits a dentist from requiring a patient to sign an agreement limiting their right or ability to file a complaint with the board.
