This bill repeals and adds to existing law to establish provisions regarding visitation rights for grandparents and great-grandparents in the state of Idaho. The key provisions of the bill include: 1. Defining key terms such as "child," "grandparent," "great-grandparent," "parent," and "visitation." 2. Establishing a rebuttable presumption in favor of a fit parent's decision regarding visitation, which can only be overcome by clear and convincing evidence that visitation would be in the best interests of the child. 3. Requiring the court to give the parent's decision special weight when considering the evidence and setting forth factors the court must consider in determining the best interests of the child. 4. Allowing the court to award reasonable attorney's fees to the parent if the petition is found to be unreasonable, frivolous, or without foundation. 5. Suspending any new or existing petitions for visitation rights and any orders establishing visitation rights if the child is the subject of a pending child protection case, until the close of the case.
