This bill adds a new section to existing Idaho law to authorize a city to develop and maintain a communications network and offer communications service within its city limits. The key provisions include: (1) allowing a city to establish, create, develop, acquire, finance, construct, equip, lease, own, maintain, and operate a communications network and offer communications service; (2) requiring the city to create a separate enterprise fund for the communications service and prohibit subsidizing it with funds from other city operations; (3) requiring the city to provide nondiscriminatory access to private communications service providers on a first-come, first-served basis; (4) prohibiting the use of eminent domain to acquire the facilities or property of other communications service providers; and (5) prohibiting the use of local improvement district funding to construct the communications network.
