This bill limits the liability of health care providers to an injured plaintiff for pain and suffering, also known as noneconomic damages, to $250,000. The bill defines "health care provider" as any person licensed in New Jersey to practice various medical professions, as well as hospitals and other health care facilities. "Professional negligence" is defined as a negligent act or omission by a health care provider in rendering professional services that is the proximate cause of a personal injury or wrongful death, provided the services are within the scope of the provider's license and not subject to any restrictions. The bill applies to all actions accruing on or after the effective date.
