This bill adds a new section to Idaho law to provide a process for individuals to change the sex indicator on their birth certificate. The key provisions are: - Individuals 18 years of age or older can submit a completed and notarized application to change the sex indicator on their birth certificate, along with a declaration that the current sex indicator does not match their gender identity and the desired sex indicator. - Individuals under 18 can also submit an application, but it must include the consent of all parents/legal guardians or a court order if a parent is deceased or cannot be located, as well as a signed statement from a licensed professional (e.g., physician, psychiatrist, psychologist) that the requested change accurately reflects the individual's gender identity. - The amended birth certificate will not be marked as amended and will not refer to the original sex indicator. - The original birth certificate, application, and supporting documents will be placed in a sealed file that can only be accessed by court order. - The provisions of this new section will only take effect if a court issues an injunction against enforcing existing Idaho law on birth certificate sex indicators.
