This bill amends Section 13A-10-41 of the Code of Alabama 1975 to change the punishment for the crime of resisting arrest. Specifically, it reduces the offense from a Class B misdemeanor to a Class A misdemeanor, except when the person uses a deadly weapon or dangerous instrument in resisting arrest, in which case it becomes a Class C felony. The bill also provides that it is excluded from the further requirements and application of Amendment 621 of the Alabama Constitution, which relates to new or increased expenditures of local funds, because it defines a new crime or amends the definition of an existing crime.
