This bill aims to enact a new section of the Ohio Revised Code (Section 1509.228) to establish conditions and requirements for the sale of brine from oil or gas operations as a commodity. The bill defines "commodity" as brine that has been processed or recycled to remove contaminants in accordance with existing regulations. The bill requires holders of relevant permits or approvals to demonstrate to the Chief of the Division of Oil and Gas Resources Management that the intended use of the commodity is not expected to result in damage or injury to public health, safety, or the environment. Once this demonstration is made, the commodity is exempt from any provisions applicable to brine, and the holder can sell it for surface application in deicing, dust control, portable restrooms, or other purposes approved by the Chief. The Chief is permitted to establish reasonable reporting requirements and collect limited samples to confirm compliance.
