This bill amends the definition of "employee" in the Massachusetts Unemployment Insurance Law. Specifically, it strikes out the existing subsection (b) and replaces it with a new provision that an individual's service is considered outside the usual course of the employer's business. It also adds a new paragraph that exempts the relationship between an automobile club and an individual performing services pursuant to a contract between the automobile club and a third party to provide automobile club services, requiring the automobile club to instead establish that the third party is a separate and independent business in order to determine if the individual is an employee of the automobile club.
