Bill Summary

This bill prohibits the New Jersey Motor Vehicle Commission (MVC) from requiring an motor vehicle insurer (insurer), licensed to do business in New Jersey that settles a total loss claim with the owner of a motor vehicle, to submit any document providing a power of attorney with regard to an application to the MVC by the insurer for the transfer of a motor vehicle certificate of ownership to the insurer or a salvage certificate of title for the motor vehicle. Further, the bill prohibits the MVC's Chief Administrator from requiring a notarized signature on a motor vehicle certificate of ownership surrender statement from a person who has received or is due to receive a total loss settlement from an insurer, or on a document authorizing the insurer or insurer's agent to act as power of attorney, in order to obtain a certificate of ownership or a salvage certificate of title.
