This bill, the Foreign Agent Disclaimer Enhancement Act of 2020 or the FADE Act of 2020, aims to amend the Foreign Agents Registration Act of 1938 to clarify the application of disclaimer requirements for informational materials posted on online platforms by agents of foreign principals. It requires such agents to ensure the conspicuous placement of the required disclaimer directly with the posted material, and allows for an abbreviated version of the disclaimer if the full statement is incompatible with the platform. The bill also applies the disclaimer requirements to persons outside the United States and requires online platforms with at least 50 million monthly U.S. visitors or users to maintain the disclaimer with shared materials. Additionally, the bill directs the Attorney General to analyze and report on challenges to enforcing the Foreign Agents Registration Act.
