This bill amends Section 1366.005 of the Texas Insurance Code to modify the conditions applicable to health benefit plan coverage of in vitro fertilization procedures. The key changes are: 1) removing the requirement that the fertilization or attempted fertilization of the patient's oocytes must be made only with the sperm of the patient's spouse, and 2) reducing the history of infertility requirement from five continuous years to simply being unable to attain a successful pregnancy through any less costly applicable infertility treatments covered by the plan. The bill applies to health benefit plans delivered, issued for delivery, or renewed on or after January 1, 2022.
