AI Summary

This bill, the "Act to Establish Pay Equity," aims to ensure that all employees in South Carolina are paid fairly, regardless of their race, religion, color, sex (including gender identity and sexual orientation), age, national origin, or disability status. It prohibits employers from paying wages at a lower rate for comparable work, with some exceptions for seniority, merit, or productivity-based systems. The bill also makes it unlawful for employers to restrict employees from discussing or disclosing their wages, or to rely on an applicant's salary history in hiring decisions. It provides for civil actions, damages, and penalties for employers who violate these provisions, and empowers the Department of Labor, Licensing and Regulation to investigate and enforce the law.
