This bill requires employers in New York to provide prior written notice to all employees upon hiring, informing them of the types of electronic monitoring that may occur, such as monitoring of telephone conversations, emails, and internet usage. Employers must also post the notice of electronic monitoring in a conspicuous place for employees. The bill grants the Attorney General the authority to enforce these provisions, and employers found in violation may be subject to civil penalties. The bill does not apply to certain processes designed for computer system maintenance or protection that are not targeted at monitoring individual employees.
