This bill allows certain workers' compensation claimants with a loss of wage-earning capacity greater than 50% to request that the Workers' Compensation Board reclassify them as permanently totally disabled or totally industrially disabled due to "extreme hardship." The bill defines "extreme hardship" as: (a) the claimant's income from disability benefits would be less than 50% of their average weekly wage after their partial disability benefits end; (b) the claimant will be unable to meet their own and their dependents' expenses after their partial benefits end; (c) additional medical, functional, or vocational factors have further eroded the claimant's wage-earning capacity since their partial disability classification; or (d) the claimant's income would be below the federal poverty guidelines after their partial benefits end.
