This bill expands the eligibility criteria for classification as permanent total disability under the New York Workers' Compensation Law. It includes an inability to perform the full range of sedentary work or approval for federal Social Security disability benefits as a result of a compensable accident or occupational disease as constituting permanent total disability, in addition to the existing criteria of loss or total loss of use of certain body parts. The bill provides further details on what constitutes the inability to perform the full range of sedentary work, including the inability to sit, walk, or stand for certain durations during an 8-hour workday, as well as non-exertional factors like visual and cognitive impairments. The bill is effective immediately and applies to injuries occurring on or after the effective date.
