This bill, the Private Detention Facility Moratorium Act, prohibits the operation of private detention facilities in the state of New Mexico. It removes the authorization for state and local governments to enter into contracts or agreements with independent contractors for the operation of detention facilities, and requires the termination of any existing contracts under certain circumstances. The bill also prohibits public funding of privately operated detention facilities and requires annual reporting on the implementation of these provisions. Certain exceptions are made for facilities that provide educational, rehabilitative, or other ancillary services to inmates, as well as facilities used for temporary detention or public health purposes. The bill declares an emergency and repeals two related sections of existing law.
