AI Summary
This bill, the Human Trafficking & Child Exploitation Act, aims to regulate indecent deceptive trade practices, update existing laws to address modern technology, and deter the erosion of community standards of decency. Key provisions include:
1) Requiring internet-enabled devices sold in New Mexico to have filters that block websites known to facilitate human trafficking, prostitution, child pornography, revenge pornography, and obscene material harmful to minors. Retailers must allow consumers to deactivate the filter for a one-time $20 fee, which will be used to fund the New Mexico Human Trafficking and Child Exploitation Prevention Grant Fund.
2) Establishing civil remedies, penalties, and unfair/deceptive trade practice violations for retailers that fail to comply with the filter requirements.
3) Creating the New Mexico Human Trafficking and Child Exploitation Prevention Grant Fund, administered by the Attorney General, to support governmental and non-governmental groups working to uphold community standards of decency and combat sex-related offenses.
4) Imposing a $5 admission fee on live adult entertainment establishments, with the revenue deposited into the grant fund.
The act will only take effect after similar legislation is adopted by four other states.
