Bill Summary

AN ACT RELATING TO CRIME; PROVIDING THAT A PRIOR FELONY CONVICTION WITHIN TWENTY-FIVE YEARS OF A SUBSEQUENT FELONY CONVICTION BE CONSIDERED FOR THE PURPOSE OF HABITUAL OFFENDER SENTENCING.

AI Summary

This bill amends Section 31-18-17 of the New Mexico statutes to provide that a prior felony conviction within twenty-five years of a subsequent felony conviction be considered for the purpose of habitual offender sentencing. Specifically, it increases the basic sentence for a person convicted of a noncapital felony who has one, two, or three or more prior felony convictions that were part of separate transactions or occurrences. The bill also clarifies the definition of "prior felony conviction" to include convictions from other states or the federal government, and defines "nonviolent felony offense" as an offense where the use or threatened use of force or a deadly weapon was not involved. The provisions of the bill apply to persons sentenced on or after July 1, 2021.
