This bill prohibits publicly owned treatment works from accepting wastewater associated with the exploration, delineation, development, or production of natural gas from high-volume hydraulic fracturing, which is defined as using more than 300,000 gallons of water for hydraulic fracturing. However, the bill allows for publicly owned treatment works to appeal to the Department of Environmental Conservation for an exemption if they can meet certain performance standards that prevent or minimize the discharge of pollutants.
