This bill amends sections of the Environmental Conservation Law to increase penalties for repeat offenders who endanger public health, safety, or the environment. Specifically, it creates higher degrees of the crime of "endangering public health, safety, or the environment" for offenders who have previously been convicted of related crimes within the past 10 years. The bill also expands the scope of the "unlawful dealing in hazardous wastes or substances" crimes to include substances hazardous or acutely hazardous to public health, safety, or the environment.
