This bill creates new provisions in the North Dakota Century Code related to mobile home park tenant rights. The key provisions are: 1) Mobile home park owners cannot require tenants who own their mobile homes to sell or transfer ownership of the home to the park owner, except as otherwise provided by law. 2) Park owners must provide tenants with at least 30 days' advance written notice of any modifications to park rules or regulations. Tenants have 3 months to remedy any failure to comply with new rules before the owner can initiate eviction proceedings, during which time the tenant must comply with the previous rules. 3) Park owners must obtain an annual license, designate an official local office, provide tenants with contact information, and acknowledge tenant inquiries or complaints within 2 business days. 4) Park owners cannot increase monthly rents for 6 months if the rent was increased in the 60 days before the park was sold. 5) Park owners can provide utility services to tenants and include the cost in the rent, but cannot charge more than the actual cost plus a reasonable administrative fee. 6) Violators of these provisions are subject to civil penalties up to $1,000 or actual damages, plus attorney's fees and costs.
