This bill amends a section of the North Dakota Century Code related to the valuation date for marital property in divorce proceedings. The key provisions are: (1) the valuation date for marital property and debt is the date mutually agreed upon by the parties, or if they do not agree, it is the date of service of the summons in the divorce action or the date the parties last separated, whichever is earlier, but not more than 60 days before the initial trial date; and (2) the court can adjust the valuation of assets or debts if there is a substantial change in value between the valuation date and the trial date, and must make specific findings that the adjusted date is fair and equitable.
