Bill Summary
AN ACT to amend the executive law, in relation to findings of the state board of parole necessary for discretionary release of incarcerated persons on parole
AI Summary
This bill amends the Executive Law to change the requirements for discretionary release of incarcerated persons on parole. It specifies that release on parole shall be granted to any eligible incarcerated person, unless the parole case record demonstrates there is a current and unreasonable risk the person will violate the law if released and such risk cannot be mitigated by parole supervision. The bill also requires the Parole Board to provide detailed, individualized, and non-conclusory explanations for denials of parole, and to report quarterly on such denials, including demographic information.
